The only reason to run lights without siren is when approaching the scene that could turn into a hostage scenario if the bad guys are alerted. When I was a cop in the USAF, we shut everything off when we got within line-of-sight of a duress alarm activation; we wanted the bad guys to come out before they knew we were there, rather than barricade themselves inside with hostages.
That being said, the retired Philly cops I work with say that when a Philly PD car is running lights and no sirens, its because they are out of their sector and don't want to attract too much attention from other cops/supervisors nearby.

Can law enforcement break laws without lights and sirens?
Yes and NO. By looking at statue all vehicles must obey traffic laws in their jurisdiction unless an audible or visual or both are activated. So yes, they do have to. That being said, there are plenty of reasons that they don't. One, if they are on a two lane road with little traffic a lot of times they won't since ALL vehicles regardless of direction of travel, MUST pull over to the right and STOP until the cop has past. There is no reason to make oncoming cars pull over stop if the lane the cop is occupying is unobstructed by other vehicles. Every car must stop, but why inconvience everybody else? Two, if the vehicle is speeding on the interstate and the cop is going the other direction, most of the time they won't. They will shut off their brake lights and slowdown, turn around in the median, and floor it to catch the speeder. Cop cars typically don't have really fast cars so it takes some time to get up to the speed the violator is going. Then they have to go faster than that speed to catch them before they take an offramp. If the cop has his/her lights on, all the speeder has to do is speed up and take an offramp. Not having lights on will "camoflauge" the cop until he gets closer. That way the cop and pull up next to the speeder or right behind to run the license plate. Also, there are some areas that very few officers. I know a CHP that patrolled the desert along the AZ border. When he patrolled, he patrolled at 85-90 MPH. He has been challenged in court a few times when someone fought a speeding ticket but he had a good reason to. He patrols a such a high speed to cover the most ground possible since 120 degree weather is not uncommon and if somebody's vehicle is broke down then it will not take long for a young child or elderly to suffer heat related injuries. So he tried to cover the most area he could to help people. Regarding intersections, if the intersection is busy, the cop SHOULD use both lights and sirens. If the intersection is clear, and I mean absolutly no traffic around, then use just the lights. However one should always use both. Once an audible and/or visual tone is use, ALL other traffic MUST yield to the emergency vehicle. Unless of course the other car is in the middle of the intersection. Busy intersections are tricky though, use must stop and slowly encroach into the intersection and make sure everybody sees you (including the young girls on cellphones). Also, don't follow and officer in the passing lane on the interstate. You never know when he/she will dive the median to turn around to go to a call or pull someone over. Getting a copy of the in car camera is a good idea, don't plan on it without a supeona. Most departments will not just hand out videos to insurance companies or the public without due cause and a supeona. |

Update: The Good: FXT is back together, gave it a welcome home present and installed my STi springs/D Specs/Group N top hats and its good as new.
The Bad: Also...got the police report...cops wrote down that I blew the light and skidded into the police cruiser..so now Geico is re-opening the case because they feel its a bit shady that I supposedly blew a light and the cops didn't write me a ticket. They are claiming they had no lights on because they had a green light and that I jumped the light and couldn't control the vehicle and skidded into them but no summons was issued...I hate to be the "oh ef the cops guy" but come on..this is really a little disturbing. |
